Know Your Rights: Immigration Enforcement

Modesto Junior College and Yosemite Community College District leaders will continue to advocate at all levels of government for the rights of our diverse student population to obtain a quality education.
 

Rights, Responsibilities & Resources for MJC Faculty and Staff

Follow these steps if a federal immigration official is on campus and requests access to student information, district records, or entrance to a facility.
 
1. REMAIN CALM AND PROFESSIONAL 
Modesto Junior College and its employees have state legal procedures and district policies we must follow. Immigration officers are required to abide by state laws.

2. ASK FOR IDENTIFICATION AND COMMUNICATE
Ask the official to identify themselves by name, identification number, and agency. Politely state, “I am not obstructing your process, but I am not the designated campus official. Please allow me to contact my supervisor.” 
 
3. NOTIFY THE COLLEGE PRESIDENT
Ask the area supervisor to refer the official to the Modesto Junior College President by phone at  209-575-6067 or in-person MJC East Campus Morris Building, Rm 201, during business hours. After hours, contact Campus Safety at 209-575-6351.
 
 
Frequently Asked Questions (FAQs)
Can I release student information to law enforcement officials?
No, any release of student information to law enforcement must be authorized by the Modesto Junior College President.  Student information is governed by the Family Educational Rights and Privacy Act (FERPA) and YCCD Board Policy and Administrative Procedure 5040-Student Records, Directory Information, and Privacy.
 
Will Yosemite Community College District (YCCD) Campus Safety enforce federal immigration laws?
  • No.  YCCD Campus Safety personnel do not have access to student immigration status.
  • YCCD Campus Safety will:
    • Not enter into agreements with law enforcement agencies or federal departments for the enforcement of federal immigration law.
    • Not honor immigration hold requests
    • Not contact, detain, or question individuals solely on the basis of declared or suspected immigration status.
Since MJC is an open campus, can law enforcement officials access all areas of campus without permission?
No. YCCD BP 3501/AP 3501-Campus Security and Access states that classrooms and other instructional areas are limited to students and employees of the college and staff areas are accessible to assigned employees and by invitation to others for college business.
 
Are there different rules for international students?
No. Campus policies also pertain to international students.

Resources are available to all staff experiencing hardships due to immigration enforcement efforts.
